Samsung Bespoke Service Design Submission Terms and Conditions (10 Jan 2022 - 3 Jul 2022)(“Bespoke Service”)

  1. This Bespoke Service is organised by Samsung Electronics Singapore Pte Ltd. of 30 Pasir Panjang Road Mapletree Business City #17-31/32 Singapore 117440 ("Samsung") and is open to customers who are residents of Singapore (as of 10 Jan 2022).
  2. Each customer is only entitled to 1 Redemption Code per Bespoke Bundle (encompassing the Samsung Galaxy Z Flip3 5G Clear Cover with Ring and Bespoke Service) purchased. Customers will be provided with the same number of Redemption Codes as the number of Bespoke Bundles purchased. If proof of purchase clearly shows that multiple Bespoke Bundles were purchased, each Bespoke Service must be redeemed using a separate Redemption Code.
  3. This Bespoke Service will commence on 10 Jan 2022 and close on 3 July 2022 11:59PM Singapore Time (“Bespoke Service Period”) via the Bespoke Service Microsite on Samsung.com (https://www.samsung.com/sg/flip3-designed-by-you/).
  4. Samsung makes no guarantee of the availability of its or any other web services and will not be held responsible for any interruption, delay or failure of service that may interfere with the ability to submit designs for the Bespoke Service.
  5. The Design Submission mechanics are as follows:
    1. Each participant must:
      1. Submit their design entries via the Galaxy Z Flip3 5G Bespoke Service microsite at https://www.samsung.com/sg/flip3-designed-by-you/, either using the Design Tool provided or uploading via the Submit Your Own option in jpeg/png file formats on 300dpi resolution settings. By submitting the final design artwork, each customer agrees to the terms and conditions herein.
      2. Include their personal details such as name, contact number and email address together with their final artwork file.
      3. Allow Samsung to use the submitted design entries on all Samsung Social Media platforms (Facebook, Instagram, YouTube etc.) and Samsung websites (samsung.com/sg and samsung.com/sg/flip3-designed-by-you/) as part of the user generated content for the Design Submission entries.
    2. Each duly posted Design artwork submission as specified herein shall be referred to as an "Design Submission".
  6. Each customer is limited to 1 Design Submission via a valid Redemption Code only through the purchase of the Bespoke Bundle. Samsung reserves the right to reject redemption applications from customers who submit incompatible file formats, incomplete designs, inaccurate details and/or due to any other reason whatsoever at Samsung’s sole discretion
  7. For the avoidance of doubt, each customer agrees that Samsung shall be at liberty to publish, promote, copy, reproduce, transmit, display, edit, adapt, modify, create derivative works of and/or otherwise distribute or use his/her Design Submission (or any part thereof, including to add any Samsung branding, logo, name, mark, and/or product image): (i) in connection with (including for the promotion and publicity of) this Bespoke Service, the Samsung brand and/or Samsung products; (ii) in any manner, format or media whether now known or hereinafter created (including without limitation on online platforms such as Facebook, YouTube, Twitter and Instagram) and in any part of the world; (iii) at Samsung's sole direction; and (iv) royalty-free and without any obligation of attribution or further consent. Each participant hereby irrevocably grants to Samsung all consents and waivers necessary in connection with the above, without further compensation to the participant and where not prohibited by written law.

    Each customer consents and agrees that his/her Design Submission may be made available by Samsung for viewing (in any manner and format) and commenting on by the public, and that comments or ratings that he/she disagrees with or is unhappy about may be published or otherwise become associated with the Design Submission.
  8. Each customer represents and warrants that (i) his/her Design Submission is original and has not been previously published; (ii) he/she possesses the exclusive rights to his/her Design/Submission submitted hereunder and has the full and unrestricted right to transfer the same to Samsung free and clear of any claims or encumbrances; (iii) the Design Submission entry shall not infringe the intellectual property, privacy, publicity or other rights or interest of any third party or result in any other liability; (iv) his/her Design Submission does not contain anything that may be deemed by Samsung to be false, misleading, pornographic, libellous, defamatory, obscene, indecent, sexually explicit, hateful, political, racist, religious, blasphemous, harassing, threatening, or otherwise illegal, offensive or objectionable; and (v) his/her Design Submission shall not solicit funds or include programs that contain viruses, Trojan horses, worms, time bombs or any other programmes designed to impair the operation and functionality of the Bespoke Service website or websites linked to the Bespoke Service website. Samsung reserves the right to moderate the entries and remove any non-compliant entry, and to report any violations to the authorities if deemed necessary.
  9. By participating in this Bespoke Service Design Submission, you consent to Samsung’s collection, use, processing and disclosure of personal information relating to you in order to conduct the Bespoke Service, and in accordance with the Samsung Privacy Policy (www.samsung.com/sg/info/privacy.html). Each participant consents to such collection, use, processing and disclosure of his/her personal information, and represents and warrants that all information provided is true and accurate in all respects. Validity of a Design Submission entry is conditional on providing this information. Each participant agrees that Samsung may, for a reasonable period of time, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to and/or telephoning the participant(s).
  10. To the maximum extent permitted by law, each participant agrees to indemnify and hold Samsung harmless from and against any and all claims, damages, liabilities, costs and expenses (including legal costs on an indemnity basis) arising from the alleged or actual infringement of any third party copyright, patent, trademark or other intellectual property rights, or other rights, any breach by the participant of these Terms and Conditions and/or otherwise arising out of or in connection with the participant’s participation in the Bespoke Service Design Submission.
  11. Samsung reserves the right to reject any Design Submission suspected of fraud, or if Samsung believes that participant's Design Submission and/or results have been manipulated in any way by machines or computers.
  12. In the event of any dispute arising from this Bespoke Service or relating to the interpretation of these Full Terms, the decision of Samsung shall be final and binding on all parties. No correspondence or further claims will be entertained.
  13. These Full Terms shall be governed and construed in accordance with the laws of Singapore, and each participant irrevocably submits to the non-exclusive jurisdiction of the courts of Singapore.
  14. If we deem the address to be invalid, the submission will automatically be rejected.
  15. For the avoidance of doubt, warranty is not covered for the Bespoke Service and installation of design on the Galaxy Z Flip3 5G Clear Cover with Ring; any cosmetic damage to outer surface/finishing and external parts of the product, including without limitation cracks, dents or scratches on the exterior casing, screen, camera lens, buttons and other attachments; and the deterioration of the product due to normal wear and tear, including without limitation rust or stains are not covered by warranty
